Practice focuses on climate change and renewable energy law, including emission reduction and renewable energy projects, policy analysis, regulatory advice and carbon trading globally. Ms. Szymanski has worked on climate change issues since 1994. Her practice is divided between cross-border and U.S. domestic carbon transactions, and she recently spent a year based in the firm's London office.
Relevant Experience
- Advise on the structuring, creation and trading of various forms of greenhouse gas emission allowances and reduction credits, in both the voluntary and compliance markets, in the U.S. and internationally
- Draft, negotiate and advise on both compliance and voluntary renewable energy certificate (REC) transactions in more than a dozen U.S. jurisdictions, including frequently for solar projects
- Advise on regulatory and transactional aspects of solar energy project developments in the United States
- Analyze new and emerging U.S. climate change-related laws and regulations to assess business risks and opportunities and options available for developing a corporate climate change program
- Seconded for two years to support the London-based carbon trading desk of a major U.S. financial institution; drafted and negotiated documentation for trading of EUAs, CERs, ERUs and VERs
- Advise clients on regulatory requirements for undertaking carbon reduction projects and for trading carbon offsets
- Negotiate ISDA, IETA, EFET and DRV carbon trading documentation on behalf of several major investment banks and trading companies; actively participated in industry working groups that drafted new versions of contracts for Phase II EU Emissions Trading Scheme (for trading EUAs, CERs and ERUs)
- Draft documentation for trading of NOx and SO2 emissions allowances
- Advise several sell-side entities on commercializing avoided deforestation verified emission reductions (VERs) in developing countries
- Provide regulatory advice to several European carbon trading operations entering US markets
- Draft and advise on emission reduction purchase agreements (ERPAs) for the primary and secondary transaction of greenhouse gas emission reductions around the world under the Clean Development Mechanism and Joint Implementation mechanism of the Kyoto Protocol
- Draft comments to U.S. Minerals Management Service regarding regulation of offshore renewable energy development in the United States
- Draft client response to U.S. Senate committee on proposed U.S. greenhouse gas cap-and-trade legislation
