Amanda's practice focuses on antitrust and trade regulation.

Amanda represents clients in antitrust litigation and government antitrust investigations. She represents clients in various industries, including manufacturing, retail, steel, energy, transportation and entertainment in merger and non-merger investigations before the U.S. Department of Justice and the Federal Trade Commission. Amanda provides compliance training and counseling to businesses and organizations on joint ventures and competitor collaborations, price discrimination, distributor relations and other competition-related issues. Amanda also represents clients in class action and other complex litigation matters.

Amanda draws on her significant experience as a Staff Attorney in the Bureau of Competition, Mergers III Division, of the U.S. Federal Trade Commission. During this time, she served as the lead attorney in negotiating consent decrees on behalf of the FTC and litigated numerous challenges to mergers and acquisitions in federal and administrative courts. In recognition of her accomplishments at the FTC, Amanda was awarded an Official Commendation for Meritorious Service.

Amanda is admitted to practice before the U.S. Court of Appeals for the Federal Circuit and the U.S. District Court for the Western District of Wisconsin.

Relevant Experience

  • Trial counsel to global high technology company in patent infringement case; case went to full trial on the merits on antitrust counterclaims.
  • Represented Universal Music Group before the Federal Trade Commission in its $1.9 billion acquisition of the recorded music business of EMI Music. After a Second Request and an extensive investigation, the FTC voted 5-0 to close its investigation without requiring divestitures or other remedies.
  • Defending a health-care products manufacturer in a multi-district class action litigation involved allegations of price fixing.
  • Defending major energy company in antitrust investigation into industry pricing practices.
  • Defending major energy company in multi-state investigation and litigation matters alleging fraud, unjust enrichment, and false claims.
  • Trial counsel to national retail and casino development company in commercial litigation resulting in favorable settlement on the eve of trial.
  • Represented Delta Air Lines before the U.S. Department of Justice in its successful acquisition of Northwest Airlines. Following a second request and extensive investigation, the DOJ closed its investigation without requiring any divestitures or other remedies.
  • Successfully advocated before the Antitrust Division of U.S. Department of Justice, resulting in the Division's decision not clear a transaction that would have combined two of the largest iron ore producers in the world. After failing to receive antitrust clearance, the parties dissolved plans to form the joint venture. Amanda worked closely with co-counsel and economists around the world to develop the best global strategy for our clients' advocacy across several jurisdictions, including in the United States. This global opposition was awarded the Global Competition Review's "M&A Transaction of the Year -- Asia-Pacific, Middle East and Africa" award in 2010.
  • Advises one of the world's largest supermarket companies on numerous antitrust issues, including the antitrust implications of mergers and acquisitions and responding to third-party subpoena from the FTC during its investigation into allegedly anticompetitive conduct by a supplier.
  • Successfully obtained federal tax-exempt status for Run to Honor, a group that honors Naval Academy Alumni lost in combat or military operations in service to our country by running the Marine Corps Marathon and participating in other athletic events.
  • Represented a global media company in an FTC investigation into antitrust issues, including standard setting involving digital rights management.
  • At the FTC, represented the federal government in numerous matters, including FTC v. Equitable Resources, Inc. et al. (3rd Cir. 2007; W.D. Pa. 2007; FTC 2007) (natural gas distribution merger investigation and litigation); FTC v. Whole Foods Market, Inc. and Wild Oats Markets, Inc. (D.C. Cir. 2007; D.D.C. 2007) (premium natural and organic supermarket merger litigation); In the Matter of T.C. Group, LLC et al. (FTC 2006) (partial equity interest acquisition investigation and negotiation of settlement under consent order); In the Matter of Dan L. Duncan et al. (FTC 2006) (consummated midstream energy acquisition investigation and negotiation of settlement under consent order); and other non-public matters.
