Health Care Labor & Employment Wage and Hour Litigation Practice

Practice focuses on all aspects of labor and employment law, including trials in Title VII, ADEA, ADA, workplace harassment and other employment discrimination cases; wrongful discharge, whistleblower and other employment torts; FLSA and other wage-hour litigation; ERISA and WARN Act litigation; no-compete and trade secret litigation; labor arbitration, NLRB cases, contract negotiation and representation in union elections and strikes; occupational safety and health; employee benefits litigation; workplace drug testing; and related advice matters.
Relevant Experience
- Extensive labor and employment litigation experience in federal and state courts, before administrative agencies and in arbitration hearings.
- Extensive wage-hour class action experience for numerous employers in federal and state courts in several states.
- Handled numerous workplace harassment and other employment discrimination suits in federal courts in several states.
- Represented large employers in labor preemption cases, including successful, multiyear challenge to state laws restricting right to operate during strikes.
- Represented Fortune 500 employer in RICO action arising out of "corporate campaign" by international labor union.
- Represented Fortune 100 employer in WARN Act suit by union on behalf of over 500 employees.
- Substantial labor relations experience, including NLRB litigation, labor arbitration, representation in strikes and related litigation and negotiation of collective bargaining agreements.
- Extensive experience in the transportation industry.
- Extensive experience in workplace drug testing issues.
