Practice focuses on environmental litigation, administrative law and environmental compliance; specifically, toxic tort defense, hazardous substance litigation, commerce clause litigation related to solid waste and other solid waste related issues, hazardous materials transportation, surface water and groundwater quality issues and wetlands.
Relevant Experience
- Represented corporate clients in defense of hundreds of related toxic tort cases alleging personal injuries and property damages due to the formulation and manufacture of pesticides.
- Represented clients, both plaintiffs and defendants, in hazardous substance litigation, including Superfund, other federal law, state law and common law causes of action.
- EPA Wetlands Enforcement Activities for ditching after National Mining Association v. U.S. Army Corps of Engineers.
- Represent waste disposal companies in commerce clause litigation, franchise disputes and environmental compliance and litigation.
- Represented defendant in farm nuisance dispute related to the operation of a hog farm.
- Represented pesticide manufacturers and other clients regarding pesticidal products and claims, efficacy testing, labeling, custom blending, biological control agents and data compensation agreements.
- Advised numerous clients regarding domestic and international hazardous materials transportation regulations.
- Participant in committees active in environmental regulation of nanotechnology and biotechnology.
- Pro bono representations include appeals on behalf of abused and neglected children.
