Practice focuses on civil and criminal litigation, administrative process, and compliance counseling in matters involving all major environmental regulatory programs, including CERCLA, NEPA, Clean Water Act (including wetlands issues), Clean Air Act, and RCRA. Practice also involves management of environmental aspects of complex business transactions and major development projects, including due diligence, environmental permitting, drafting and negotiation of transaction documents, and post-closing administration of contractual indemnities. Representative clients include chemical manufacturers, waste management companies, banks and other financial service institutions, electric utilities, and developers.
Relevant Experience
- Represents major waste management company in CERCLA litigation involving sites in numerous jurisdictions, including New Jersey, New York, Pennsylvania and Puerto Rico.
- Represents chemical manufacturing company in strategic management of environmental liabilities associated with current and divested plant sites in the U.S., Canada, Mexico and Europe and in litigation and ADR regarding related indemnity claims.
- Represents major investment bank in connection with privatization projects at numerous military installations.
- Represents real estate developer in litigation under NEPA and Clean Water Act challenging an environmental permit for a major redevelopment project at the Meadowlands Sports Complex.
- Represents chemical manufacturing company on CERCLA and RCRA matters in connection with former weapons manufacturing facility in North Carolina.
- Supervised environmental due diligence and negotiated and drafted environmental agreements for numerous real estate transactions, commercial financings, and development projects (including gas-fired power plants and wind-powered generating facilities).
- Represented waste management company in defending toxic tort suit related to Superfund site in New Jersey.
- Represented energy company in defending NEPA challenge to permits for electric transmission line connecting new generating facilities in Mexico with the U.S. electric grid in California.
- Represented the Commonwealth of Virginia and the Cities of Virginia Beach and Chesapeake in connection with a BRAC order regarding the realignment of a major Navy jet base.
- Represented mining company in CERCLA litigation regarding cleanup of mine site in Maine.
- Defended PTOW official and beverage production company in criminal prosecutions under the Clean Water Act.
- Represented major national bank in litigation involving liability for cleanup of a contaminated manufacturing facility in South Carolina.
- Negotiated numerous multilateral agreements for the transfer of air emission credits.
- Participated in numerous administrative rulemaking proceedings involving federal regulation of wetlands under the Clean Water Act.
- Participated in numerous administrative rulemaking proceedings under the Clean Air Act, as well as related federal appellate court litigation.
