Practice focuses on equal opportunity law, labor relations, labor arbitrations, collective bargaining, executive employment agreements, wage-hour law, occupational safety and health law and litigation of employment claims under federal and state labor and employment statutes.
Relevant Experience
- Extensive trial experience as lead counsel in the defense of class action and collective action suits under Title VII of the Civil Rights Act, the Fair Labor Standards Act, the Equal Pay Act, ERISA, and the Labor Management Relations Act; class action experience includes representation of several Fortune 500 companies in the chemical, paper, tobacco, power and transportation industries; representative cases include Gantlin et al. v. Westvaco Corp., 734 F.2d 980 (4th Cir. 1984); Rowe et al. v. Allied Chemical Hourly Employees’ Pension Plan et al. 915 F.2d 266 (6th Cir. 1990); Adkins et al. v. E. I. DuPont de Nemours & Co., Inc., 1996 U.S. Dist. LEXIS 10944.
- Substantial experience in the defense of union organizational campaigns and representational elections; experience includes serving as lead attorney in the successful defense of union petitions involving 5200 employees, 3500 employees, and 700 employees at three electric utilities.
- Served as primary counsel for various corporations in compliance audits by the Office of Federal Contracts Compliance Programs, including Glass Ceiling (headquarters) audits for several Fortune 500 corporations and in the defense of Commissioner “systemic” charges by the EEOC.
- Extensive advice practice related to corporate restructuring, downsizing, acquisitions, executive employment contracts and covenants not to compete.
