Practice focuses on matters which involve significant environmental issues, including litigation, other adversarial proceedings, transactions, compliance and regulatory affairs, including those involving toxic torts, Superfund, RCRA, water quality, Brownfields, and related matters.
Relevant Experience
- Served as lead counsel in administrative proceedings opposing a challenge to the 401 Water Quality Certification for the relicensing of a hydroelectric project.
- Served as counsel in administrative proceedings challenging the issuance of an Interbasin Transfer Certificate.
- Led company and legal team in environmental due diligence investigations related to 17 manufacturing facilities and dozens of inactive sites as part of debt restructuring, stock sale, and subsequent closing of a revolving loan for a multinational chemical company. Also coordinated legal representation with a dozen law firms in the United States and 16 other countries in Europe, Asia, and North and South America as part of the corporate diligence and other transactional issues.
- Facilitated closing of corporate acquisition as part of representation of leading shareholder in conjunction with environmental claims raised immediately prior to closing.
- Organized, led and managed jury trials and a class settlement in Georgia state courts involving personal injury and property damage claims relating to a CERCLA Site, serving as Liaison Counsel for defendants in cases involving over 650 plaintiffs. Testified as a witness on the issue of reasonableness of litigation expenses and settlement costs in a trial of subsequent litigation for contribution from other defendants.
- Served as lead counsel in the settlement of litigation between EPA and the lead PRP’s relating to EPA’s response costs at a Superfund Site in Georgia, including a 106(b) petition before the U.S. Environmental Appeals Board to obtain reimbursement from EPA of over $12 M spent in complying with EPA’s Removal Order.
- Served as co-lead trial counsel in 40 days of administrative proceedings before the North Carolina Office of Administrative Hearings contesting a civil penalty and potential remediation order. The litigation involved experts testifying on numerous issues, including fate and transport issues for surface water and groundwater; toxicity of toluene, benzene and other alleged carcinogens; and the admissibility of laboratory evidence.
- Appeared as lead counsel and defended or prosecuted numerous cases in state, federal and administrative courts for over 20 years in cases involving CERCLA, RCRA, Clean Water Act and state environmental laws and regulations.
- Advised clients on matters related to compliance with state and federal environmental laws as part of ongoing operations of wood treating, used oil reclamation and other industrial and chemical operations.
- Advised clients and assisted lead counsel in conjunction with criminal investigations related to environmental laws.
