Practice focuses on environmental litigation, with emphasis on hazardous waste and toxic tort disputes. Representative clients include waste handling companies, electric utilities, chemical companies and consumer product manufacturers.
Relevant Experience
- Defended companies in many of the most complex and challenging cases brought under the Federal Superfund statute.
- Thirty-two years of experience litigating cases involving claims under the major federal environmental statutes, including CERCLA, RCRA, Clean Air Act, Clean Water Act and TSCA.
- Counseled corporate clients on requirements for compliance with state and federal environmental laws and regulations.
- Regularly provides advice to companies seeking to minimize the environmental liabilities associated with corporate acquisitions and property purchases.
- Extensive experience in the filing of comments in EPA rulemaking proceedings and in the prosecution of challenges to EPA rules before the federal district courts and federal courts of appeals.
- Frequently has served as common counsel to represent industry groups in the prosecution and also in the defense of contribution and cost recovery claims for waste site cleanup costs.
- Defended numerous federal court and state court lawsuits throughout the United States involving toxic tort claims for personal injury and property damage.
