Ms. Field's practice focuses on environmental and administrative law, with emphasis on representation of companies in permitting matters, in enforcement actions brought by USEPA under the Clean Air Act, and in federal rulemakings and litigation arising under the Clean Air Act. Representative clients during the past 30 years include electric utilities, chemical companies, pulp and paper mills, refineries, coal facilities, and flexible packaging companies.

Relevant Experience
  • Provided advice to energy, chemical and pulp and paper industry clients on a full range of Clean Air Act permitting issues, with particular emphasis on the permitting of new sources and the permitting of existing sources subject to USEPA's federal operating permit program.
  • Defended and negotiated to a successful conclusion several federal Clean Air Act enforcement actions brought by USEPA as part of that Agency's new source review (NSR) enforcement initiative. (These are cases where the federal government alleges that companies have undertaken major projects without first following the requirements of the federal new source review permitting program.)
  • Defended and successfully resolved an enforcement action involving a major chemical manufacturing company charged with violating the Clean Air Act's hazardous emissions standards and in which liability was substantially limited by developing - and prevailing on - a lack of fair notice defense.
  • Served as lead counsel for industry in complex litigation in the United States Court of Appeals for the D.C. Circuit, challenging USEPA's regulations to control pollutant emissions from virtually all large facilities in the eastern United States.
  • Represented coalitions of industry sources in major federal Clean Air Act rulemakings to develop a national operating permit program (the Title V permit program), national ambient air quality standards, and Clean Air Act enforcement programs.
  • Participated on behalf of a major industry coalition in USEPA's federal advisory committee to reform that Agency's new source review regulations.
  • Provided advice to clients on a full range of Clean Air Act permitting issues, with particular emphasis on the permitting of new sources and the permitting of existing sources subject to USEPA's federal operating permit program.
