Labor and employment practice focuses on all areas of employment and labor law, including litigation and advice involving discrimination issues, breach of employment contracts, defamation, assault and battery, and emotional distress claims; wage and hour matters; union elections; unfair labor practices cases; strikes; union negotiations; arbitration and mediation.
Relevant Experience
- As Chief Counsel, served as principal advisor to National Labor Relations Board Member and supervised staff of 18 attorneys in drafting major Board decisions.
- Served as trial and appellate attorney, U.S. Department of Justice, for 16 years; litigated “pattern and practice” employment discrimination cases in federal district court, represented federal agencies (FDA, CPSC, BATF, DOD, HHS, NSA) in the United States Courts of Appeals and Supreme Court, handled patent litigation in the Supreme Court and criminal and civil antitrust cases involving movie distribution, newspapers, trade books, magazines, physicians, gasoline and road building.
- Represented assisted living company, national baking company and major truck manufacturer before the NLRB in connection with union organizational campaigns, NLRB elections and unfair labor practice proceedings.
- In the United States Supreme Court, won a reversal for a hospitality employer in an age discrimination in employment case and successfully defended a hospital employer in a national origin discrimination case.
- Represented national motel chain in Title VII, ADEA, ADA and FLSA cases in federal and state courts.
