Air Environmental New Source Review Superfund
|
Practice focuses primarily on rulemaking, litigation, compliance counseling, permitting, and enforcement proceedings under the Clean Air Act. Mr. Jaber also has substantial experience in litigation under the superfund law (CERCLA) and in compliance counseling and enforcement under hazardous waste laws (RCRA).
Relevant Experience
- Represented several utility companies, petroleum transport and storage company, paper company, and cement company in defense of enforcement actions under the New Source Review Provisions of the Clean Air Act. Activities included advising companies in responding to EPA and State investigations, settlement negotiations, and participating in administrative and federal court litigation (at all levels, from the District Court to the Supreme Court).
- Represented utility and other industry organizations in rulemakings under the Clean Air Act (including the New Source Review "reform rules") and in associated litigation in the United States Court of Appeals for the D.C. Circuit.
- Advised companies on Clean Air Act permitting and compliance issues. Successfully represented utility in defending New Source Review permit in United States Court of Appeals.
- Represented industrial manufacturer in commenting on Clean Air Act rule, filing a petition for review, and negotiating a favorable settlement with EPA.
- Represented PRPs in litigation under Superfund.
- Advised owner/operator of hazardous waste recycling facility on compliance issues under RCRA and state analogs.
- Assisted in post-closure due diligence for the privatization of the refineries and oil installations of the Kingdom of Morocco.
