Patricia S. Gill

Ms. Gill is Counsel on the firm's Labor & Employment Team.  She represents management in all aspects of employment and traditional labor law and defends employers in federal and state courts and before governmental agencies.  Ms. Gill has significant litigation experience in discrimination, harassment, retaliation and tort cases, including cases targeting executives and cases involving allegations of egregious conduct.  She regularly counsels union and non-union employers on employee relations matters, proper classification of workers, wage and hour issues, and compliance with the Fair Credit Reporting Act, Family and Medical Leave Act and Americans With Disabilities Act.  Ms. Gill has extensive experience advising clients in the energy, health care, hospitality, manufacturing and food services industries.

Relevant Experience
  • Defended national employers in numerous administrative proceedings before the EEOC and single and multi-plaintiff lawsuits alleging violations of Title VII of the Civil Rights Act of 1964, §1981, the Age Discrimination in Employment Act, and the Americans With Disabilities Act.
  • Successfully tried a federal court jury trial in a multiple-count race discrimination and retaliation case for a Fortune 200 energy company, obtaining a complete defense verdict; obtained numerous summary judgment and other dismissals of discrimination, harassment and retaliation lawsuits.
  • Defended publicly traded energy company in high-profile Sarbanes-Oxley, Section 806 whistleblower action before the Department of Labor and in federal court; advised clients on proper handling of internal employee complaints to minimize risks of SOX retaliation claims.
  • Advised unionized employers in collective bargaining negotiations, conducted contract-interpretation and discipline/discharge labor arbitrations, and defended dozens of unfair labor practice charges. 
  • Guides companies through strategic workforce restructurings, reductions in force, and mergers and acquisitions, including purchase/sale of unionized entities.
  • Counsels clients on health care reform issues and is a member of the firm's Health Care Reform initiative.
  • Negotiates and drafts executive employment agreements, non-compete and other restrictive covenants, and severance agreements.
  • Proactively leads clients in achieving favorable resolutions of disputes with employees before lawsuits are filed; develops practical, cost-efficient and creative solutions to complex employee relations problems.
