Practice focuses on labor and employment law representing employers in federal and state court proceedings, counseling clients on day-to-day labor and employment matters, structuring corporate reorganizations to avoid employment law pitfalls, including developing objective selection criteria, exit incentives, preparing retention and employment contracts and designing executive compensation.
Relevant Experience
- Successfully defended numerous whistleblower cases under various statutes, including Section 211 of the Energy Reorganization Act, and what is thought to be the first Section 806 Sarbanes-Oxley case filed in federal district court, including obtaining a precedent-setting ruling that the plaintiff was not entitled to a jury trial.
- Devotes a considerable amount of time to traditional Labor law matters, including trial of matters before the National Labor Relations Board, union avoidance, contract negotiations and union issues resulting from merged or acquired work forces.
- Successfully handled several high-profile employment termination disputes as well as represented clients on the enforcement of employment arbitration awards and motions to compel the arbitration of statutory claims in both state and federal courts.
- Obtained very favorable results in complex FSLA litigation and in defending wrongful discharge and discrimination claims in both arbitrations and court proceedings, handling more than 100 such matters in the last ten years.
