Mr. Kuner's practice focuses on data protection and electronic commerce, and in particular on data protection compliance projects for multinational clients in areas such as human resources, pharmaceuticals, financial services, and technology. He also counsels and represents companies in their dealings with national data protection regulators and the Article 29 Working Party. Mr. Kuner was listed as a "leader in his field" in Chambers Global 2006, 2007 and 2008, and was named the "go-to person for EU privacy" in the Computerworld survey of "The best Privacy advisers in 2008" for the second consecutive year. A frequent speaker, he is author of the books "Internet für Juristen" (Verlag C.H. Beck 1996 and 1999), "European Data Privacy Law and Online Business" (Oxford University Press 2003), and "European Data Protection Law: Corporate Compliance and Regulation" (2nd edition, Oxford University Press 2007), a Chinese version of which was also published in 2008 by Law Press China. The author of over 40 legal articles in English and German, in the summer of 2009 Mr. Kuner was a Visiting Fellow at the Oxford Internet Institute of Oxford University. Mr. Kuner was also named by The Burton Foundation as one of the "Best Law Firm Writers of 2010".
Relevant Experience
- Successfully negotiating the European Commission's adequacy decisions regarding the standard contractual clauses for controller-to-controller transfers (2004) and controller-to-processor transfers (2010); drafting BCRs application checklist approved by Working Party 29 (2007).
- Representing clients in numerous negotiations with the European Commission, the Article 29 Working Party, and European data protection authorities. For example, successfully negotiated guidelines on merchant fraud databases for the payment industry with the Article 29 Working Party, and assisted with the safe harbor membership of SWIFT.
- Assisting multinational clients in complying with requirements of European data protection law, such as drafting data transfer agreements, joining the US safe harbor system, adopting binding corporate rules (BCRs), dealing with employee data issues, and performing data protection audits.
