Endangered and Threatened Species Environmental Environmental Enforcement and Defense Land Use & Land Use Litigation Superfund Waste Water Quantity Wetlands, Endangered Species & Natural Resources

Practice focuses on environmental and administrative law, with an emphasis on wetlands permitting and associated issues under the Clean Water Act, NEPA, and the Endangered Species Act, and on CERCLA and hazardous waste cases throughout the country. Prior to entering private practice, Ms. Brown was an Attorney-Advisor in the Solicitor's Honors Program in the Office of the Solicitor, U.S. Department of the Interior, advising client agencies, including the Fish and Wildlife Service and Bureau of Reclamation, on environmental matters. Representative clients include water agencies, trade associations, solid waste companies, and developers.
Relevant Experience
- Represent national industry association in litigation challenging rules issued by the EPA and Army Corps of Engineers under Section 404 of the Clean Water Act.
- Counsel to coalition of water agencies in litigation challenging the Bureau of Reclamation's operation of the Rio Grande River under the Endangered Species Act.
- Counsel to water district in litigation challenging the Bureau of Reclamation's operation of the lower Colorado River and proposed lining of the All-American Canal under NEPA and the Endangered Species Act.
- Represent major waste management company in CERCLA, RCRA, and Natural Resource Damages litigation and alternative dispute resolution proceedings involving sites in New York, New Jersey, Pennsylvania, Massachusetts, and Puerto Rico.
- Represent land developers on jurisdictional determinations and the use of general permits under Section 404 of the Clean Water Act.
- Advised landowner on options for development and sale of property inhabited by endangered species.
