Biotechnology Intellectual Property Life Sciences Patent Practice

Practice focuses on representation of technology-based companies of all sizes in matters relating to patents, trademarks, copyrights and trade secrets.
His experience includes the development of intellectual property protection strategies and implementation plans for emerging growth companies and large established companies in the chemical, petrochemical, medical, pharmaceutical, biotechnology, food processing and related industries. He also represents a number of public and private universities in these areas. His representation for such clients also includes preparation and prosecution of applications for patents and trademarks in the United States and throughout the world, counseling clients with respect to validity and infringement issues raised by intellectual property rights of third parties, evaluation of intellectual property assets of clients and third parties in connection with acquisitions and mergers, and licensing and other intellectual property contract negotiation.
He also has represented clients in all types of intellectual property litigation in the state and federal courts and before the International Trade Commission.
Relevant Experience
- Represented plaintiff in multi-patent jury trial in E.D. Va., obtained verdict of infringement, willful infringement and 60% reasonably royalty.
- Successfully defended an athletic shoe manufacturer in numerous patent infringement actions, including one challenging the validity of company’s key foundation patent; all settled or dismissed on summary judgment and affirmed at Federal Circuit.
- Defending private label infant diaper manufacturer in several patent infringement actions brought by major name brand manufacturers; all settled on favorable terms.
- Represented numerous biotech and medical device companies in licensing and other partnering transactions with big pharma valued at over $50MM.
- Represented venture capital funds in IP due diligence for biotech investments totaling over $100MM.
- Represented university and Nobel Prize-winning professor in complex interference; favorably settled after winning all key preliminary motions.
