Practice focuses on all aspects of labor and employment law. Defends employers in federal and state courts and arbitral forums based on a wide range of claims, including discrimination; harassment; wrongful discharge; retaliation; sexual assault; defamation; fraud; intentional infliction of emotional distress; breach of contract; negligent hiring, supervision, and retention; and negligent maintenance of safe premises. Represents employers before various administrative agencies, such as the Equal Employment Opportunity Commission, the Department of Labor, and the Texas Workforce Commission Civil Rights Division (formerly the Texas Commission on Human Rights). Regularly advises employers regarding various employee relations issues.
Relevant Experience
- First chaired numerous arbitrations obtaining favorable awards in cases in which claimants' alleged claims of workers' compensation retaliation; age discrimination; race discrimination; national origin discrimination; retaliation; sex discrimination; sexual harassment; violation of the Family and Medical Leave Act; negligent hiring, retention, and supervision; negligent maintenance of premises; vicarious liability; breach of contract; intentional infliction of emotional distress; and constructive discharge.
- Defended cases involving allegations of sexual assault.
- Handled cases involving the argument that the Defense Base Act provided an employee with his or her exclusive remedy.
- Obtained directed verdict in an arbitration in which the claimant alleged that she was sexually assaulted based on, among other things, the argument that the Defense Base Act provided her exclusive remedy.
- On trial team that obtained favorable jury verdict for an employer in a sex and national origin discrimination case.
- Obtained dismissal of several lawsuits by summary judgment.
- Obtained dismissal of claims on motions to dismiss for failure to state a claim.
- Obtained dismissal of lawsuits on motions to dismiss for lack of personal jurisdiction and lack of subject matter jurisdiction.
- Obtained several court orders enforcing agreements to arbitrate.
- Obtained court orders enforcing arbitration awards.
- Successfully handled appeals of orders granting summary judgment, orders confirming arbitration awards, and orders granting motions to compel arbitration.
- Assisted in defense of Sarbanes-Oxley whistleblower case including briefing that resulted in a ruling that plaintiff was not entitled to a jury trial.
- Defended lawsuits alleging violation of the Americans with Disability Act public accommodation provisions.
- Prepared arbitration programs and agreements, employment policies, confidentiality agreements, employment agreements, affirmative action plans, severance agreements, and retention agreements.
- Assisted employers in major reorganizations and consolidations of their workforces.
- Conducted sexual harassment training for several employers.
