Practice focuses on antitrust, intellectual property, and other complex commercial litigation at the trial and appellate level.

Relevant Experience Trial:

  • Defending multinational corporations in putative class actions alleging price-fixing, tying, exclusive dealing, monopolization, and other antitrust violations in multiple federal district courts.
  • Defending building products supplier in antitrust action alleging a supply reduction conspiracy and price-fixing.
  • Defended major defense contractor in antitrust action alleging exclusive dealing and other antitrust claims related to a government procurement. Case voluntarily dismissed by plaintiff. 
  • Counsel of record in challenge to proposed Food and Drug Administration regulatory action. Case settled on terms favorable to client.
  • Defended corporate officer in action alleging breach of contract, fraud, and other business torts. Briefed and argued early dispositive motion, which was granted by the court.
  • Represented client pro bono in trial concerning guardianship of minor.

Appeals:

  • Briefed and argued on behalf of appellant manufacturer in appeal before the U.S. Court of Appeals for the Fourth Circuit. The Fourth Circuit reversed adverse bankruptcy and district court opinions in favor of the manufacturer. In re Strack, 524 F.3d 493 (4th Cir. 2008).
  • Representing appellants in appeal before the U.S. Court of Appeals for the District of Columbia Circuit concerning antitrust claims alleging foreclosure of chemical supply needed to produce certain drugs indicated for treatment of anxiety disorders.
  • Counsel of record for appellant software manufacturer in appeal before the U.S. Court of Appeals for the Federal Circuit concerning a trade secret.
  • Drafted briefs to the U.S. Supreme Court in cases involving antitrust, environmental, and constitutional issues, and counseled clients on Supreme Court practice.

Investigations:

  • Represented multinational corporations in investigations by the U.S. Department of Justice, Federal Trade Commission, and State Attorneys General.
  • Conducted internal investigations on antitrust, securities, and corporate management issues.
