Complex Consumer and Financial Services Litigation

Practice focuses on commercial litigation, class action defense, internal investigations, cyber security, and commercial contract disputes, with an emphasis on mortgage lending and other financial services.
Relevant Experience
- Defends and prosecutes a variety of commercial litigation matters in state and federal courts (including multi-district litigation) throughout the United States, including:
- Cases, including trial experience, for national consumer lenders and creditors in connection with a variety of consumer litigation in Georgia and the surrounding states. Matters include bankruptcy-related and mortgage issues, alleged violations of federal lending statutes, such as TILA, RESPA, and FCRA, alleged violations of state statutes regulating mortgage lenders, and common law tort claims.
- Substantial experience with aggressive creditor actions.
- Class actions involving a major internet service provider's charges, insurance companies' claims evaluation software, national banking associations' transaction posting order, and the security breach of a payment processor's computer network.
- Internal investigations regarding technology, consumer services outsourcing, banking regulatory compliance, cyber intrusions of financial institutions, and information security remediation.
- Advised financial institutions and a national supermarket chain on regulatory compliance in the data protection area.
