Practice focuses on all aspects of European and Belgian information technology and media law with emphasis on data protection and e-commerce issues. Mr. Burton assists multinational clients in complying with the requirements of European and Belgian data protection law, in particular in developing strategies for local and international compliance, handling notification procedures, joining the US Safe Harbor program, implementing binding corporate rules and standard contractual clauses, dealing with employee, customer and consumer data issues, and performing data protection audits.

He also assists clients in their dealings with the Belgian data protection authority (Commission de la protection de la vie privée) and advises them in connection with data protection related topics, such as online profiling and behavioral advertising, cloud computing, social networks, mobile devices and location data, RFID, e-discovery, employee monitoring, internal investigations, whistleblowing hotlines, telecommunications secrecy, and use of CCTV and biometric systems.

Relevant Experience

  • Advising a major Belgian company in connection with the migration of its e-mail server to a cloud computing platform.
  • Assisted a major US company in responding to a request for information from the Belgian data protection authority regarding its privacy notice and consent languages.
  • Attend Council of Europe sessions on profiling on behalf of the ICC.
  • Advised numerous clients on how to handle foreign legal requirements  conflicting with EU data protection law (such as US and Japanese SOX, e-discovery procedures, OFAC obligations, requests from foreign authorities or governments).
  • Advised an online careers and recruitment company focusing on the Belgian market about its data protection compliance strategy, including preparation of privacy notices, terms of use, registration with the Belgian DPA and international data transfers.
  • Prepared a study for the European Commission on the interaction between online copyright enforcement and data protection in selected Member States.
  • Advised numerous clients on how to conduct a corporate internal investigation in compliance with EU privacy and data protection requirements.
  • Advising one of the largest oil and gas companies in connection with its strategy for international data transfers and compliance with European data protection law, including preparation of binding corporate rules.
  • Prepared global privacy policies and websites terms of use for several multinational clients, including local addenda.
  • Advising the leading independent specialty pharmaceutical company in the US on the preparation of its online privacy policy, online survey and marketing materials.
  • Advising one of the major Belgian food retailers on its strategy for implementation of a whistleblowing hotline in five European countries and on the conduct of internal investigations.
  • Advising a major financial service provider on its European and Belgian data protection compliance scheme, including strategy for European compliance, self-certification to the US Safe Harbor program, marketing and profiling legal requirements, implementation of an online rewards and loyalty program, registration with local data protection authorities, and review of privacy policies, terms and conditions, and service provider agreements.
  • Advising different stakeholders in connection with the review of the e-Privacy Directive and of the General Data Protection Directive.
  • Advising the leading non-profit organization for the standardization of electronic product codes and RFID on European data protection issues.
  • Advising one of the world's leading manufacturers and marketers of skin care and cosmetics products in connection with their online privacy policy, terms and conditions, and use of online marketing technologies such as web survey, web beacons, cookies, etc. across Europe.
  • Advising copyright holder representatives on the relationship between the enforcement of copyright on the Internet and data protection law at a European and national level.
  • Advised a global medical technology leader on its strategy for pan-European data protection compliance in 14 countries.
  • Advised a major US chemical company regarding data processing outsourcing and international data transfers across Europe and the US.
  • Advised a large multinational conglomerate manufacturer of sporting and fitness equipment, boats and engines in connection with its strategy for pan-European data protection compliance in 15 countries.
  • Advised a global telematic service provider on data protection, telecommunication law and the implementation of e-call services in Belgium and Switzerland.
