Mason A. Weisz

Mr. Weisz assists clients in identifying, evaluating and managing risks associated with privacy and information security practices. He advises clients on GLB, HIPAA, COPPA, CAN-SPAM, FCRA/FACTA, security breach notification laws and other U.S. and international privacy and data protection laws (including those in the EU and Latin America). He drafts and negotiates contracts concerning data use, security and confidentiality and privacy notices, policies and procedures.

Mr. Weisz also represents clients on a wide range of intellectual property issues, with particular emphasis on copyright and trademark litigation and licensing. He has extensive experience with issues relating to the Internet, new media technologies and e-commerce.

  • Advised clients on implementation of enterprise-wide data privacy and security programs.
  • Advised e-commerce clients on compliance with laws and regulations governing the privacy of telephone service subscribers.
  • Advised clients on instant messaging and email marketing strategies and compliance with the CAN-SPAM Act.
  • Advised multinational retailer on the privacy and information security issues associated with the development and distribution of mobile commerce application.
  • Developed strategies for domestic and international companies to minimize liability for user-generated online content and implement advantageous copyright licenses in Web 2.0 applications.
  • Advised clients on responding to information security breaches and compliance with state security breach notification laws, including the development of notification strategies.
  • Drafted privacy policies, procedures and notices for multiple online and offline consumer goods retailers and service providers.
  • Drafted numerous website terms of use.
  • Drafted software license and end-user license agreement (EULA) for m-commerce application.
  • Assisted in comprehensive company-wide privacy and information security assessment including reviews of use, disclosure, storage and disposal of personal information.
  • Assisted multinational retail company with the development and implementation of a company-wide information management program.
  • Counseled m-commerce clients on provision of requisite notices and opt-out mechanisms and compliance with federal regulation of direct marketing to mobile devices.
  • Advised major utility on legal implications of web analytics technologies, including web beacons / web bugs.
  • Drafted privacy and data security amendments and certifications for clients' contracts with service providers.
  • Negotiated advantageous settlement of numerous litigations involving allegations of unfair competition and deceptive trade practices.
  • Represented numerous clients in Internet, publishing, media, television, film, music, art and fashion industries in state and federal courts.
  • Represented international software developer in connection with successful effort to obtain federal court order voiding an arbitration subpoena that had sought disclosure of its trade secrets.
  • Represented major publisher in successful defense of litigation alleging that it had fraudulently manipulated its search engine ranking and that of alleged competitors.
  • Represented theater production company in successful defense of litigation alleging that use of plaintiff's trademark in the metadata of the company’s website constituted an unfair and deceptive trade practice.
  • Represented trade association and its members in successful anticounterfeiting litigation campaign.
  • Represented major world music record label in successful defense of litigation alleging copyright, unfair competition and antitrust violations.
