Bobby's practice focuses on commercial real estate transactions (including development, financing and leasing) and mitigation banking (including wetland, stream and species conservation).

Bobby's practice focuses on two areas. The first is commercial real estate transactions, including acquisitions and dispositions, real estate finance, loan workouts and foreclosures, leasing and construction. Bobby represents both lenders and borrowers in connection with financings, workouts and foreclosures, and he represents both landlords and tenants in retail, industrial, office and medical office leasing.

The second focus area is wetland and stream mitigation banking and species conservation banking. Bobby advises clients with respect to the creation, development and operation of mitigation and conservation banks and with respect to the sale of credits generated from those banks. Working on these matters, Bobby routinely handles issues relating to land acquisition, land use and development (including zoning), construction and local, state and federal laws and regulations. Bobby also interacts with state and federal regulatory agencies as needed.

Relevant Experience

  • Finance and Restructuring: Represented secured lender in foreclosure of a large, undeveloped tract of land in Northern Virginia; in addition to foreclosure issues, this matter involved analyzing complex land use issues (including proffers, zoning and development restrictions).
  • Finance and Restructuring: Represented secured lender in workout of non-performing loan secured by gasoline stations and convenience stores located throughout the eastern US.
  • Finance and Restructuring: Represented borrower in workout of non-performing loan secured by ski resort property.
  • Finance and Restructuring: Represented secured lender in foreclosure of convenience stores, hotels and motels and laundromats.
  • Finance and Restructuring: Represented lender in financing $90 million, multi-phased student housing project.
  • Finance and Restructuring: Represented landowner in acquisition, financing and refinancing of mining facility.
  • Finance and Restructuring: Represented apartment building owner in refinancing of its loan.
  • Finance and Restructuring: Represented clients in real estate matters relating to tax exempt financing transactions.
  • Natural Resources (Mitigation Banking): Represented clients in acquisition, creation, development and operation of wetland and stream mitigation banks throughout the US.
  • Natural Resources (Mitigation Banking): Represented client in acquisition, creation, development and operation of species conservation banks.
  • Natural Resources (Mitigation Banking): Represented clients in real estate matters involving conservation easements and associated tax credits.
  • Land Use and Development: Represented clients in acquisition and disposition of real estate assets, including undeveloped land, commercial office buildings, industrial facilities and condominium development.
  • Land Use and Development: Represented client in joint venture for acquisition of land and construction and development of biomedical research and office facility and associated parking structure.
  • Land Use and Development: Represented client in acquisition of land and development of an industrial manufacturing and testing facilities as part of economic development agreement with Commonwealth of Virginia.
  • Land Use and Development: Represented client in acquisition of land and development of beverage production facility as part of economic development agreement with Commonwealth of Virginia.
  • Land Use and Development: Represented client in acquisition of land and development of food production facility as part of economic development agreement with Commonwealth of Virginia.
  • Leasing: Represented tenant in lease of 300,000 square feet of office space in a to-be-constructed building to serve as its worldwide corporate headquarters.
  • Leasing: Represented client in restructuring its nationwide portfolio of leased properties in connection with corporate reorganization.
  • Leasing: Represented property owners in the sales/leasebacks of regional headquarters building and mail distribution and sorting facility.
  • Leasing: Represented landlords and tenants in connection with ground and commercial leasing, including space for office, medical office, industrial, retail, educational, biotechnology and biomedical uses.
  • Commercial Real Estate (Title Claims): Represented lender in filing and resolving title claims relating to loans it originated and subsequently sold; title issues involved either title agent's failure to record mortgages or title agent’s failure to issue loan policies.
  • Commercial Real Estate (Title Claims): Represented client in filing and resolving title claims for hundreds of residential loans owned by client and originated by now defunct lender; title issues related to lack of priority of client's mortgages.
