Shelley's practice focuses on all aspects of intellectual property law including patent litigation and preparation related to ecommerce, business methods, software-related inventions and other technical areas. Shelley also has experience handling complex litigation for both plaintiffs and defendants.

Shelley is admitted to practice before the US Patent and Trademark Office.

Relevant Experience

  • Represented prepaid card service provider accused of patent infringement in TGIP, Inc. v. AT&T Corp., et al (E.D. Tex.). After obtaining summary judgment of non-infringement on majority of products at issue, settlement reached before trial. (2007) 
  • Represented plaintiff patent owner ePlus in ePlus, Inc. v. SAP (E.D. Va.), in infringement litigation involving electronic procurement systems. Case was favorably settled while awaiting the court's decision following a four-week trial. (2006) 
  • Represented large national bank as plaintiff in a patent infringement action against PayPal, Inc. (D. Del.) resulting in a favorable settlement following the completion of fact discovery. (2004)
  • Prepared opinions on validity and infringement for patents directed to Internet-related systems and business methods. 
  • Prosecuted patent applications related to e-Commerce and the Internet, business methods, architectural design, and mechanical inventions. 
  • Representing plaintiff patent owner asserting patent infringement against multiple defendants in fragrance packaging industry. (E.D. Va. 2010-present) 
  • Represented pork processor in civil RICO action against labor union and co-defendants (E.D. Va.). Litigation resulted in multiple published decisions and groundbreaking legal precedent regarding the application of racketeering laws to labor unions' corporate pressure campaigns. Case was favorably settled prior to trial. 
  • Represented defendant propane gas supplier against violations of Virginia Trade Secret Act (E.D. Va.) resulting in favorable settlement prior to discovery. 
  • In international child abduction cases, represented plaintiff parents in cases proceeding under the Hague Convention on International Child Abduction. ( E.D. Va. and W.D. Va.) Pro bono in cooperation with the National Center for Missing and Exploited Children.
