Hunton & Williams LLP acted as counsel to the remarketing agents for the remarketings of $38,000,000 Development Authority of Bartow County, Pollution Control Revenue Bonds (Georgia Power Company Plant Bowen Project), First Series 1997 (the  “Bartow County Bonds”), $27,000,000 Development Authority of Burke County, Pollution Control Revenue Bonds (Georgia Power Company Plant Vogtle Project), Fifth Series 1995 (the “Burke County Bonds”), and $40,000,000 Development Authority of Monroe County, Pollution Control Revenue Bonds (Georgia Power Company Plant Scherer Project), First Series 2009 (the “Monroe County Bonds” and, together with the Bartow County Bonds and Burke County Bonds, the “Bonds”).  The Bonds are tax-exempt obligations of Georgia Power Company (“Georgia Power”). 

The Bartow County Bonds were initially issued to provide funds to refinance the cost of the acquisition, construction, installation and equipping of certain air and water pollution control and sewage and solid waste disposal facilities  located at Georgia Power’s Bowen steam electric generating plant in Bartow County, Georgia.  The Monroe County Bonds were initially issued to provide funds to refinance the cost of the acquisition, construction, installation and equipping of Georgia Power’s interest in certain air and water pollution control and sewage and solid waste disposal facilities located at the Scherer steam electric generating plant in Monroe County, Georgia. The Burke County Bonds were initially issued to provide funds to refinance the cost of the acquisition, construction, installation and equipping of Georgia Power’s interest in certain air and water pollution control and sewage and solid waste disposal facilities located at the Vogtle steam electric generating plant in Burke County, Georgia.

Georgia Power is engaged in the generation, transmission, distribution, and purchase of electricity and the sale of electric service within the State of Georgia, at retail in over 600 communities (including Athens, Atlanta, Augusta, Columbus, Macon, Rome, and Savannah), as well as in rural areas, and at wholesale currently to OPC, MEAG Power, Dalton, various EMCs, and non-affiliated utilities.
