The Environmental Protection Agency and the U.S. Army Corps of Engineers recently issued revised guidance in an effort to clarify the scope of Clean Water Act protection. Deidre Duncan, a partner with the firm, commented on the significance of the changes in the revised guidance. The new guidance didn't take on any tough issues, and in some areas it appeared the agencies were making it simpler for regulators to make jurisdictional determinations, as Duncan noted.

Duncan advises clients on environmental permitting, compliance, and litigation matters regarding the Corps of Engineers' Civil Works Program.
