On September 10, 2024, the European Commission and the European Data Protection Board (“EDPB”) issued a press release stating that they would be cooperating to develop guidance regarding the interplay between the Digital Markets Act (“DMA”) and the EU General Data Protection Regulation (“GDPR”).

The European Commission and the EDPB consider that “developing a coherent interpretation of the DMA and GDPR while respecting each regulators’ competences in areas where the GDPR applies and is referenced in the DMA is crucial to effectively implement the two regulatory frameworks and achieve their respective and complementary objectives.”

This enhanced cooperation will build upon the engagement and cooperation that already exists between the European Commission and the EDPB within the context of the High-Level Group for the DMA.
