In the evidence arena, often overlooked at first, in-house counsel must know the pitfalls and develop strategies for discovery and evidence management and the use of privilege to avoid and mitigate litigation risk. They must also be prepared if a lawsuit does result. This program is designed to help you understand the pitfalls and develop successful strategies to manage these issues. Topics covered will include:
- When the duty to institute a legal hold attaches and what it entails under expanding E-discovery jurisprudence
- Incident and event investigation, and managing future discoverability of findings and results
- Post-incident and pre-suit duties to customers, third parties and/or regulatory bodies
