Hunton Launches Interactive Extended Producer Responsibility Legislation Tracker

Hunton Andrews Kurth LLP is pleased to announce the launch of its interactive Extended Producer Responsibility (EPR) Legislation Tracker, a comprehensive tool dedicated to monitoring and analyzing EPR legislation for plastic packaging, paper products, and textiles across all 50 states.

“Our new EPR Tracker reflects the firm’s commitment to providing clients with timely, practical resources as the environmental regulatory landscape rapidly evolves,” said Rachel Saltzman, a partner in Hunton’s environmental practice. “With EPR laws gaining momentum and varying significantly by state, our tracker will empower stakeholders to proactively monitor compliance requirements and anticipate trends that could impact their operations.”

EPR laws generally require producers of certain consumer products to join Producer Responsibility Organizations (PROs). These organizations collect fees from producers to fund state recycling initiatives and infrastructure improvements.

While EPR requirements vary by state, they all share the goal of improving waste management and recycling outcomes by making producers responsible for the lifecycle of their products. In addition to full EPR programs, some states have enacted EPR study laws, directing agencies to evaluate how such programs could be implemented in their jurisdictions.

Hunton’s EPR Tracker focuses on plastic packaging, paper products, and textiles, providing up-to-date information and analysis on legislative developments and regulatory changes. The Tracker is designed to help companies, trade associations, and other stakeholders stay informed about the evolving legal landscape and manage compliance obligations efficiently.

Recent EPR Trends:

  • As of January 2026, seven states have enacted full EPR programs for packaging.
  • California enacted the nation’s first EPR program for textiles in 2025.
  • We expect to see continued movement in 2026. Illinois, Massachusetts, Hawaii, and Rhode Island have all undertaken needs assessments for potential EPR programs for packaging (and, in some cases, other products).
  • Several states are also considering textile EPR legislation.

Hunton’s Extended Producer Responsibility Legislation Tracker will follow and provide updates on these developments. In addition to tracking new legislation, Hunton is guiding clients through state implementation processes by assisting with compliance planning and broader risk management, including advising on producer obligations, data collection, and internal audit processes and supporting contractual negotiations with value chain partners.
